Will the ELD mandate be delayed?

::introtext::Earlier in the month, the House Transportation Committee attached a directive to this year’s Transportation, Housing and Urban Development (THUD) appropriations bill. At the time, there was speculation that the event could end up delaying or repealing the Federal Motor Carrier Safety Administration’s (FMCSA) ELD mandate set to go into effect on December 18.::/introtext::

What do we think?

Our ELD experts have made a few good points in response to the speculation:

  • ELD is tied to the MAP21 bill, which was previously passed by a republican congress/senate.
  • The FMCSA, CSA and American Trucking Association (ATA) are all in favor of ELD.
  • The Owner Operator Independent Driver Association (OOIDA) is against ELD and filed lawsuits up to the Supreme Court.
  • The Supreme court threw out the OOIDA lawsuit stating MAP21 was law.
  • In order to overturn or delay ELD, both the congress and senate, which are republican again, would have to pass the THUD bill with the ELD rider proposed attached.
MiX Telematics is therefore of the opinion that the delay is unlikely to happen and that the current deadlines for the ELD Mandate will remain in place.
